Kutztown University State Vehicle Violation Policy
Violations of the Kutztown University Vehicle Policy 1988-120 are rated by the severity of the violation.
MINOR Violation – A violation causing inconvenience to the University Garage or the Administrative Services Office.
Infractions include but are not limited to the following:
· State vehicle automotive activity sheet is not properly completed
· Vehicle was not returned in a clean condition
· Lights left on in state vehicle
· Personal vehicle parked in state vehicle space at the University Garage
MAJOR Violation – A violation that causes a problem for another state vehicle user, University Garage, or the Administrative Services Office.
Infractions include but are not limited to the following:
· Driver and/or passengers were smoking in state vehicle
· Keys were not returned to the University Garage or the Administrative Services Office
· Non-payment of traffic or parking ticket(s)
· Vehicle was left at a location other than the University Garage
· Vehicle was returned to the University Garage after date and time stated on state vehicle request form
· Vehicle was taken from the University Garage before the date and time stated on the state vehicle request form
· Vehicle was parked in the wrong parking space or behind another vehicle
· Vehicle left unlocked
· Vehicle windows were left open
SEVERE Violation- A violation causing potential harm/damage to self, others, or state vehicle.
Infractions include but are not limited to the following:
· Accidents that are determined to be the fault of the driver due to carelessness, neglect, reckless driving, or DUI
· Accident with state vehicle that was not reported
· Driver was under the influence of alcohol or a controlled substance while operating the state vehicle
· Keys left inside state vehicle
· Driver cited/ticketed for speeding, carelessness, recklessness or DUI
· State vehicle left idling while not attended
· Tampering with a state vehicle to prevent discovery of an accident
· Unauthorized passenger(s) in state vehicle
· Use of a state vehicle for any non-official business purpose
Penalties
Three or more Minor violations during a semester may result in the suspension of
driving university fleet vehicles for 30 days.
Two or more Major violations during a semester may result in the suspension of
driving university fleet vehicles for 90 days.
One or more Severe violations may result in the possible restriction of driving privileges of the university fleet vehicles for one year or permanent suspension of driving university fleet vehicles.
Appeal Process
Submit an appeal letter within 10 business days of the date of the violation letter. All appeals should be submitted to Mr. Silberman, interim, Vice President, Administration and Finance, 305 Stratton Administration Center. Mr. Silberman shall respond to the appeal letter within 10 business days of the receipt date of the appeal letter.
