Major Violations

The following acts shall be regarded as grievous affronts to the University community warranting the status of Major Violations to the Kutztown University Student Code of Conduct. In the event a student commits a major violation which also violates local, state or federal law, the University may employ the principal of dual jurisdiction (as defined in 4.2.2 of the Document on Student Rights and Welfare).

Falsification of Documents
Any student willfully falsifying, omitting, or forging admissions application, academic or financial aid transcript, Kutztown University or Commonwealth ID cards or attempts to misrepresent himself/herself as an official of the University is prohibited.

Violations of Law
Violation of local, state, or federal criminal statutes which occur on campus or on University leased property or facilities, automatically are violations of the University Code of Conduct. When such violations occur off campus and because of the nature of the offense there is an adverse effect to the health, safety or well being of the University or its members, students may be subject to disciplinary action. Students in receipt of Accelerated Rehabilitative Disposition (ARD) through a plea arrangement, or any other related program, are considered to be accountable under this standard.

Substance Use/Abuse
The possession, use, and/or sale of alcoholic beverages on the Kutztown University campus or University leased property, at official University student activities on or off-campus (except as noted in policy for special events), or in a University-owned, University-leased, or KUSSI-owned vehicle being used to transport students to activities or events is prohibited, as are the following:

  1. Hosting or organizing a party involving five or more people in the halls or nearby grounds at which alcoholic beverages and/or drugs are being used will be given notice to terminate their occupancy in the residence halls. It is to be understood that the penalty of suspension from the residence halls or from the University is available for any drug or alcohol infraction.
  2. Selling alcohol without a license or furnishing alcohol to a minor on or off-campus is prohibited.
  3. The possession, use and/or sale of controlled substances, narcotics or other illegal drugs is prohibited.
  4. Constructive possession of alcoholic beverages and/or illegal drugs is prohibited. This type of possession is defined as the presence of a substance in an area under one's control such as a residence hall room in which the student is assigned or a vehicle.

Ethnic Intimidation
Any violation of law, University conduct standard or policy based on the actual or perceived age, ancestry, color, creed, disability, gender, national origin, race or sexual orientation of an individual or group of individuals.

Assault/Harassment
Assault and/or battery, the threat of physical harm upon another member of the University Community or oneself either on or off-campus is prohibited. Additionally, lewd, indecent conduct, public nudity, harassment of a sexual nature in person or via a communicative device is considered assault/harassment, where harassment is defined as one or more acts of threatening, demeaning, or seriously embarrassing behavior.

Property
Certain areas of the campus and surrounding properties are declared off-limits to students and designated as restricted. These areas include, but are not limited to, the water towers, quarry, electrical substations, cemetery, areas under construction or repair, roof tops, and buildings closed during university recess.

The willful obstruction of a passageway, entrance, exit, or any portion of a university building which restricts the freedom to utilize the facility for its stated and intended purpose is prohibited. Additionally, deliberate destruction or abuse of university or individually owned property including vandalism, and theft of university or individually owned property or service is considered a major violation.

Tampering, discharging or causing to be inoperable any fire fighting apparatus, alarm devices, fire safety devices and emergency equipment for no legitimate purpose and/or initiating bomb threats or false fire alarms to any campus facility is prohibited.

Technology
Unauthorized or illegitimate use of Kutztown University computer or audiovisual systems, resources, software, equipment and/or facilities is prohibited.

Weapons
Unauthorized possession or use of firearms, including pellet/BB devices, knives (minimum 6-inch blade) switchblade, chemicals, or other dangerous weapons (or fireworks) on campus is a major violation.
