Purpose
To prohibit the use and/or sale of alcoholic beverages, except under listed circumstances, at Kutztown University.

Scope
The sale and use of alcoholic beverages is prohibited on University campus, at any University sponsored event or in any University-owned, University-leased, Student Government Association SGA-owned or SGA-leased vehicle being used to transport students to officially approved activities or events, except as described in the special events identified in section D.

Special Events and Tailgating
Alcoholic beverages are permitted on campus only by exception by the University President or his/her designee for special events on campus or at official off-campus special events as part of a University reviewed and approved function. Tailgating for sporting events in designated locations for sporting events does not require special permission. The following requirements must be met whenever alcohol is served for special events or is present during tailgating:-
The University President or his/her designee must review and provide approval for each event at which alcohol would be served. The approval should be sought at least 30 days prior to the event.

Alcohol may be served only in designated areas. The area to be used must be included in the request to the President.

All Commonwealth laws and University rules and regulations regarding the serving of alcohol must be followed.

No University or SGA funds may be used to purchase alcohol.

The providing of alcohol must be coincidental to the event. The function must also provide nonalcoholic beverages, food and/or snacks.

The request to serve alcohol for special events must address the following items:

Date, time, and purpose of the function.

Rationale for serving alcohol.

Number of persons who will attend the function and method of supervision, if students will be in attendance and, if so, how many.

Location, time, and method the alcohol is to be served.

Letter from off-campus establishment indicating acceptance of responsibility for serving alcohol.

Evidence of liquor license, as appropriate.
-
Inclusion of designated driver program, as appropriate.

At off-campus events, alcohol may be provided only on a "cash bar" basis by the establishment, unless otherwise approved by the President or his/her designee. Written confirmation must be obtained and submitted with request.

Kutztown University does not condone, under any circumstance, the serving of alcoholic beverages or permitting alcoholic beverages to be served to any minor or visibly intoxicated person by anyone.

Sponsorship of the event includes responsibility for reasonable supervision during the event. Supervision includes appropriate ratio of staff to attendees and responsibility to notify proper authorities regarding violations of law, specifically possession or consumption by a minor, furnishing alcohol to minors or public drunkenness.

Tailgating is permitted in designated event parking areas in association with sporting events, where sporting events are defined as either Intercollegiate Athletics or club sport events between Kutztown University and another university or college that occur on the campus of Kutztown University and does not require special permission from the President or his/her designee during the following times:

Three hours before the start of the sporting event

Halftime intermissions

One hour following the conclusion of the sporting event

Tailgaters must incorporate a substantial quantity of food into the activity and non- alcoholic beverages must be offered

No kegs or other large volume containers will be permitted

All alcoholic beverages must be poured into containers made of plastic or like substances. No visible cans, bottles, or glass containers are permitted.

All tailgaters must have in their possession a valid game ticket once the sporting event has commenced.

Tailgating locations, recreational vehicle parking areas, and other procedures regarding tailgating are available through the Department of Intercollegiate Athletics and Public Safety.
